Terms of Service

Welcome to Tan and Glow! These Terms of Service ("Terms") govern your use of our spray tanning services, website, and online booking application (collectively, the "Services"). We provide professional spray tanning services both at our salon location in Port Moody, British Columbia, and as a mobile service at your location. By using our Services, booking an appointment, or receiving spray tanning services, you agree to be bound by these Terms.
Please read these Terms carefully. If you do not agree to these Terms, you may not use our Services.
1. DEFINITIONS
For purposes of these Terms:
- "Company," "we," "us," or "our" refers to Tan and Glow, a spray tanning business operating in Port Moody, British Columbia.
- "Client," "you," or "your" refers to any individual using our Services.
- "Salon Services" refers to spray tanning services provided at our Port Moody location.
- "Mobile Services" refers to spray tanning services provided at your location within our service area.
- "Services" includes all spray tanning services, whether provided at our salon or your location.
2. ACCEPTANCE OF TERMS
By accessing our website, booking an appointment through our online booking system, receiving our Services, or providing us with your contact information, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are booking services for a minor, you represent that you are the parent or legal guardian of such minor and agree to be bound by these Terms on their behalf.
3. ELIGIBILITY AND AGE REQUIREMENTS
3.1 Minimum Age
You must be at least 18 years of age to book and receive our Services independently. Clients under 18 years of age must have written parental or legal guardian consent and must be accompanied by a parent or guardian at the time of service.
3.2 Health and Safety Requirements
You represent and warrant that you do not have any medical conditions, skin sensitivities, or allergies that would make spray tanning unsafe for you. You agree to disclose any relevant allergies, skin conditions, or sensitivities before receiving Services. We reserve the right to refuse service to anyone for health and safety reasons.
4. SERVICES DESCRIPTION
4.1 Salon-Based Spray Tanning
We provide professional spray tanning services at our salon location in Port Moody, British Columbia. Our salon services include custom shade matching, professional application, and post-tan care instructions. Retail products including tan extenders and skincare items may also be available for purchase.
4.2 Mobile Spray Tanning Services
We offer mobile spray tanning services at your location within our service area. Mobile service availability is subject to scheduling and geographic limitations. Additional terms for mobile services are outlined in Section 9.
5. BOOKING AND APPOINTMENTS
5.1 Online Booking
You may book appointments through our online booking system, by phone, via text message, or in person. When creating an account, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
5.2 Cancellation Policy
To avoid cancellation fees, you must cancel or reschedule appointments with adequate notice:
- Salon Services: Must cancel at least 24 hours in advance. Cancellations with less than 24 hours notice will be charged 50% of the service fee.
- Mobile Services: Must cancel at least 48 hours in advance. Cancellations with less than 48 hours notice will be charged 50% of the service fee.
- No-Shows: Failure to appear for a scheduled appointment without prior notice will result in a charge of 100% of the service fee.
5.3 Late Arrivals
If you arrive more than 15 minutes late for your appointment, we reserve the right to reschedule your appointment or reduce your service time accordingly. Repeated no-shows or late cancellations may result in restriction from future bookings or requirement of advance payment.
5.4 Rescheduling
You may reschedule appointments without penalty if done within the cancellation notice periods specified above. Rescheduling requests made after these deadlines will be subject to the same cancellation fees.
6. PAYMENT TERMS
6.1 Service Pricing
All services must be paid in full at the time of booking or service completion. We accept major credit cards, debit cards, and other payment methods as posted at our salon or on our website. Current pricing for salon and mobile services is available on our website and may vary based on service type and travel distance for mobile appointments.
6.2 Price Changes
We reserve the right to change our prices at any time. Price changes will be reflected on our website and booking system. Appointments booked prior to a price change will honor the original quoted price.
6.3 Package Deals and Promotions
We may offer package deals, promotional pricing, or special offers from time to time. All package deals and promotional offers are subject to specific terms and conditions, including expiration dates. Packages must be used within the specified timeframe and are non-refundable and non-transferable unless otherwise stated.
6.4 Refunds
Due to the personalized nature of our services, all sales are final. We do not provide refunds for completed services. If you are dissatisfied with your service, please contact us immediately so we can work to resolve your concerns.
7. SMS AND TEXT MESSAGE COMMUNICATIONS
7.1 Consent to Receive Text Messages
By providing your mobile phone number to Tan and Glow, you expressly consent to receive text messages (SMS) from us for the following purposes:
- Phone Number Verification: To verify your phone number when creating an account or updating your contact information.
- Appointment Notifications: Appointment confirmations, reminders (typically sent 24 hours before your appointment), cancellation notifications, and schedule changes.
- Service Updates: Important updates about your services, account status, or booking modifications.
- Pre and Post-Service Instructions: Preparation guidelines before your appointment and aftercare instructions following your spray tan.
- Marketing Communications: Promotional offers, special discounts, seasonal promotions, and marketing messages about our services and products (you may opt out of marketing messages at any time as described below).
7.2 Message Frequency and Charges
Message frequency varies depending on your booking activity and preferences. Appointment-related messages are sent as needed based on your bookings (typically 1-2 messages per appointment). Marketing messages may be sent up to 4 times per month. Message and data rates may apply as determined by your mobile carrier. You are responsible for all charges incurred from your carrier for text messages.
7.3 Opting Out of Text Messages
You may opt out of receiving text messages at any time:
- Marketing Messages Only: Reply STOP to any marketing text message, or manage your preferences in your online account settings. You will continue to receive appointment-related notifications.
- All Text Messages: Contact us at info@tanandglow.com or call 604-555-GLOW (4569) to completely opt out of all text messages. Note that opting out of appointment notifications may result in missed appointments.
After you opt out, you will receive one final confirmation message. Please allow up to 10 business days for your opt-out request to be fully processed.
7.4 Message Content and Accuracy
While we strive to provide accurate and timely text messages, we do not guarantee the timeliness, accuracy, or completeness of any messages. Messages may be delayed or not delivered due to factors beyond our control, including carrier issues, network problems, or technical difficulties. You should not rely solely on text messages for critical appointment information and should verify important details through other means.
7.5 Supported Carriers and Technical Requirements
Our text messaging service is available on most major Canadian carriers. Not all mobile devices or carriers support text messages. For help with text messages, text HELP to the number from which you received the message, or contact us at info@tanandglow.com.
8. SERVICE PREPARATION AND AFTERCARE
8.1 Pre-Service Requirements
To achieve the best results from your spray tan, you agree to:
- Exfoliate your skin 24 hours before your appointment
- Avoid applying lotions, oils, deodorant, or makeup on the day of your appointment
- Shave or wax at least 24 hours before your appointment
- Wear loose, dark clothing to your appointment
- Arrive with clean, dry skin
Failure to properly prepare for your service may result in unsatisfactory tan results. We are not responsible for tan quality issues resulting from inadequate preparation.
8.2 Post-Service Care
After your spray tan, you must:
- Wait the recommended time before showering (typically 8-12 hours)
- Avoid water, sweat, and exercise during the development period
- Pat your skin dry after showering and avoid scrubbing
- Moisturize daily to extend the life of your tan
- Avoid chlorine, hot tubs, and exfoliation for 48 hours
We will provide detailed aftercare instructions following your service. Failure to follow aftercare instructions may result in premature fading, streaking, or uneven color.
9. MOBILE SERVICE TERMS
9.1 Service Area
Mobile spray tanning services are available within our designated service area in and around Port Moody, British Columbia. Service availability and any additional travel fees will be confirmed at the time of booking. We reserve the right to decline mobile service requests outside our service area or when logistical constraints prevent service delivery.
9.2 Client Responsibilities for Mobile Services
For mobile services, you agree to:
- Provide a suitable, clean, and well-ventilated indoor space for the spray tanning application (minimum 6x6 feet of clear space)
- Ensure the space has adequate lighting and comfortable temperature
- Move or cover nearby furniture, flooring, and other surfaces that you wish to protect from overspray
- Ensure access to the location at the scheduled appointment time, including parking availability
- Secure any pets during the service for safety reasons
- Provide accurate address, parking information, and any access instructions (e.g., gate codes, apartment numbers)
- Notify us of any stairs or accessibility considerations
We use professional pop-up tanning tents and protective measures, but minimal overspray may occur. We are not responsible for any damage to your property resulting from the spray tanning process, particularly when you have not followed our preparation guidelines or provided an unsuitable space.
9.3 Mobile Service Cancellations
Mobile services require 48 hours advance notice for cancellation. This extended notice period accounts for travel coordination, scheduling, and equipment preparation. Cancellations with less than 48 hours notice will be charged 50% of the service fee. No-shows will be charged 100% of the service fee.
10. HEALTH, SAFETY, AND LIABILITY
10.1 Health Consultation and Disclosure
Before receiving spray tanning services, you must disclose any relevant medical conditions, skin sensitivities, allergies to cosmetic products, or pregnancy. While spray tanning is generally considered safe, you acknowledge that individual reactions may vary. You have been advised to consult with a healthcare provider if you have concerns about whether spray tanning is safe for you.
10.2 Risks and Considerations
You acknowledge and understand the following about spray tanning services:
- Spray tanning solution may cause allergic reactions or skin irritation in some individuals
- Results vary based on individual skin type, preparation, and aftercare
- Spray tan solution may temporarily stain clothing, bedding, towels, or other fabrics, particularly if contact occurs before the first shower
- The tan is temporary and will fade naturally over 5-10 days
- Color intensity and longevity depend on skin type, preparation, and aftercare practices
- Spray tanning does not provide sun protection
10.3 Patch Test
If you have sensitive skin or concerns about allergic reactions, we recommend requesting a patch test at least 24-48 hours before your full spray tan appointment. While patch tests can help identify potential sensitivities, they do not guarantee that you will not experience a reaction.
10.4 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU EXPRESSLY AGREE THAT USE OF OUR SERVICES IS AT YOUR SOLE RISK. TAN AND GLOW, ITS OWNERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR SKIN IRRITATION, ALLERGIC REACTIONS, UNSATISFACTORY TAN RESULTS, STAINING OF PERSONAL PROPERTY, OR ANY OTHER PERSONAL INJURY OR PROPERTY DAMAGE.
10.5 Assumption of Risk and Release
By using our Services, you voluntarily assume all risks associated with spray tanning services, including but not limited to the risks described in Section 10.2. You agree to release, indemnify, and hold harmless Tan and Glow from any and all claims, damages, losses, or expenses (including legal fees) arising from your use of our Services, including claims related to allergic reactions, skin irritation, property damage, or unsatisfactory results.
11. RESULTS AND SATISFACTION
While we strive to provide excellent spray tanning results, we cannot guarantee specific outcomes due to variations in individual skin types, skin preparation, and aftercare practices. Tan color and longevity depend on many factors beyond our control. If you are dissatisfied with your results, please contact us within 24 hours of your service so we may discuss the matter and work toward a resolution. Touch-ups or adjustments may be offered at our discretion.
12. CONDUCT AND SAFETY
To ensure a safe and professional environment for all clients and staff, you agree to:
- Follow all staff instructions and posted rules
- Treat our staff with respect and courtesy
- Refrain from disruptive, threatening, or inappropriate behavior
- Not be under the influence of alcohol or drugs during your appointment
- Respect the privacy and comfort of our staff during services
We reserve the right to refuse service, terminate appointments, or ban individuals from receiving future services for violating these rules or engaging in inappropriate conduct. No refunds will be provided for services refused or terminated due to client misconduct.
13. INTELLECTUAL PROPERTY
All content on our website and in our booking application, including but not limited to text, graphics, logos, images, photographs, and software, is the property of Tan and Glow or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.
14. PRIVACY AND DATA PROTECTION
Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the practices described in our Privacy Policy, including our collection and use of your contact information for appointment notifications and marketing communications.
15. MODIFICATIONS TO TERMS
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and/or sending you notice via email or text message. Your continued use of our Services after such modifications constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
16. TERMINATION
We reserve the right to terminate or suspend your access to our Services, including your booking account, at any time, with or without cause or notice, for any reason including but not limited to violation of these Terms, non-payment, fraudulent activity, or inappropriate conduct. Upon termination, you will remain liable for all outstanding amounts owed.
17. DISPUTE RESOLUTION
17.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
17.2 Jurisdiction
Any disputes arising from or relating to these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts located in British Columbia, Canada.
18. MISCELLANEOUS
18.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tan and Glow regarding your use of our Services and supersede all prior agreements and understandings.
18.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
18.3 Waiver
No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
18.4 Assignment
You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms without restriction.
